guide for bequest by will or living trust

Your bequest to the Tiger Missing Link Foundation will perpetuate your support for our mission of providing rescue and rehabilitation of big cats that have been abused, neglected or displaced. Bequests are a wonderful way to give because you arrange to donate some of your assets after you no longer need them. In a bequest to the Foundation, you may leave a specific dollar amount, (for example, $10,000) or may leave a percentage of your estate.

This guide is provided to you so that you can see some your options for arranging a bequest. It also provides the correct legal name of the Foundation, so please be sure to bring this guide with you when you meet with your attorney.

When making or revising your will, you should work with an attorney. Here is some suggested language for various types of bequests.

  1. Outright bequest in will
    1. Specific dollar amount: "I bequeath the sum of $_____ to the Tiger Missing Link Foundation, 17552 F.M. 14 Tyler, TX 75706, to be used or disposed of, for the benefit of the Tiger Creek Wildlife Refuge, Inc.”
    2. Specific property (personal property): "I bequeath to the Tiger Missing Link Foundation, 17552 F.M. 14 Tyler, TX 75706, to be used or disposed of, for the benefit of the Tiger Creek Wildlife Refuge, Inc.”
    3. Specific property (real estate): "I devise all of my right, title and interest in and to the real estate located at to the Tiger Missing Link Foundation, 17552 F.M. 14 Tyler, TX 75706, to be used or disposed of, for the benefit of the Tiger Creek Wildlife Refuge, Inc.”
    4. Share of, or entire residue, of estate: "I devise and bequeath (all/or _____%) of the remainder of my property to the Tiger Missing Link Foundation, 17552 F.M. 14 Tyler, TX 75706, to be used or disposed of, for the benefit of the Tiger Creek Wildlife Refuge, Inc.”
  2. Conditional bequest in will Insert the conditional language in one or more of the above provisions. For example:
    "If my husband/wife does not survive me, I bequeath the sum of $_____ to the Tiger Missing Link Foundation, 17552 F.M. 14 Tyler, TX 75706, to be used or disposed of, for the benefit of the Tiger Creek Wildlife Refuge, Inc.”
    If the gift to the Tiger Creek Wildlife Refuge is for a purpose other than unrestricted use, insert the restriction in place of the words "to be used or disposed of for the benefit of the Tiger Creek Wildlife Refuge, Inc.” For example:
    "I bequeath the sum of $_____ to the Tiger Missing Link Foundation, 17552 F.M. 14 Tyler, TX 75706, for the following use and purpose:."
    If you make a gift subject to a restriction, we suggest including one of the following provisions:
    "However, I impose no legal or equitable obligation in this regard."

    or

    "If in the judgment of the Board of Directors of the Tiger Creek Wildlife Refuge, Inc., it becomes impossible to accomplish the purposes of this gift, the income or principal may be used for such related purposes and in such manner as determined by its Board of Directors."

Please discuss with us any restrictions you in mind before you execute your Will. While we try very hard to honor each donor’s wishes, we would like an opportunity to agree to your restrictions before we receive your bequest.
